LEE COUNTY UTILITIES (LCU)
YACHT CLUB COLONY WATER SYSTEM REHABILITATION


A public hearing will be held (on October 7, 2014) to adopt the Initiating Resolution for the YACHT CLUB COLONY DISTRIBUTION SYSTEM REHABILITATION project. On May 7, 2012, Lee County was appointed receiver of the Bayshore Utility Company, a private water company providing water service to the Yacht Club Colony subdivision. The water system was constructed originally in the late 1950s and needs to be replaced.
Lee County Utilities (LCU) has designed the water rehabilitation project to improve the potable water quality and fire protection within the subdivision. The water system construction costs will be funded from LCU reserves and after construction, LCU will be reimbursed by the Yacht Club Colony benefitted property owners through an assessment. The project costs will be based on final costs for system design, permitting and construction.  The boundaries of the improved area affected are:

The total project cost is estimated to be $1,546,284.00. Each benefitted property within the Project boundary, as defined herein, will be charged the total assessment for project costs, estimated to be $7,434, and the Water Connection Fee of $1,000 per property, for a total financing option of $8,434. Property owners will also be required to pay a Meter Drop-in Fee of $260 due at the time of connection. If a property owner chooses to finance the assessment and the water connection fee, then the estimated cost to the property would be $10,469.30 (including interest) which can be paid in annual installments of $525.80 for a period of 20 years not to exceed 2.2% per annum. The final assessment will be based on actual construction costs and may be different from the estimated assessment contained herein.  The public hearing will take place on Tuesday, the 7th day of October, 2014, at 9:30 AM at the Lee County Board of County Commissioners Chambers in the Old Lee County Courthouse 2nd floor, 2120 Main Street, Fort Myers, FL.

Notice is hereby given that the Board of County Commissioners of Lee County, Florida will consider the enactment of a county ordinance in accordance with Article VIII, Section 1, of the Florida Constitution and Chapter 125, Florida Statutes.  A description of the proposed county ordinance is as follows:

Copies of this Notice and the proposed ordinance are on file in the Minutes Office of the Clerk of the Circuit Court of Lee County.  The public may inspect or copy the Ordinance during business hours at the Division of Public Resources.  The Minutes Office and the Division of Public Resources are located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida.

 

Interested parties may appear at the meeting, in person or through a representative, and be heard with respect to the proposed ordinance.

 

Anyone wishing to appeal the decision(s) made by the Board with respect to the matters considered at the meeting will need a record of the proceedings.  Generally, a verbatim record, including all testimony and evidence upon which the appeal is to be based, will be necessary.

Notice is hereby given that the Board of County Commissioners of Lee County, Florida will consider the enactment of a county ordinance in accordance with Article VIII, Section 1, of the Florida Constitution and Chapter 125, Florida Statutes.  A description of the proposed county ordinance is as follows:

 

AN ORDINANCE AMENDING LEE COUNTY LAND DEVELOPMENT CODE, CHAPTERs 14, 30, 33, AND 34, TO PROVIDE FOR THE NORTH OLGA COMMUNITY PLANNING AREA (NORTH OLGA); amending chapter 14 (ENVIRONMENT AND NATURAL RESOURCES) TO INCLUDE REFERENCE TO NORTH OLGA; amending chapter 30 (SIGNS) TO INCLUDE REFERENCE TO NORTH OLGA; AMENDING CHAPTER 33 (PLANNING COMMUNITY REGULATIONS) to INCLUDE  regulations pertaining to the NORTH OLGA COMMUNITY PLANNING AREA AND TO CREATE ARTICLE X, DIVISIONS 1, 2, AND 3 INCLUDING PROVISIONS FOR APPLICABILITY, COMMUNITY BOUNDARY, COMMUNITY REVIEW REQUIREMENTS, VOLUNTARY COMPLIANCE for existing developments, DEVIATIONS AND VARIANCES, DESIGN STANDARDS FOR WATER MANAGEMENT, PARKING, SETBACKS, ARCHITECTURAL STYLE, PERMISSIBLE BUILDING MATERIALS, BUILDING COLOR, LANDSCAPING, TREE PRESERVATION, SIGNAGE AND PERMITTING home occupationS with outside help;    amending chapter 34 (ZONING)to include REFERENCE TO north olga; AND PROVIDING FOR CONFLICTS OF LAW; SEVERABILITY, CLARIFICATION; SCRIVENER’S ERROR; MODIFICATION AND AN EFFECTIVE DATE.

 

There will be two public hearings held on two separate dates in the County Commissioners= Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida.   The first public hearing will be held on Tuesday, the 7th day of October, 2014, at 5:00 PM, or as soon thereafter as can be heard.  The second public hearing will be held on Tuesday, the 21st day of October, 2014, at 9:30 AM, or as soon thereafter as can be heard. 

 

Copies of this Notice and the proposed ordinance are on file in the Minutes Office of the Clerk of the Circuit Court of Lee County.  The public may inspect or copy the Ordinance during business hours at the Division of Public Resources.  The Minutes Office and the Division of Public Resources are located in the Courthouse Administration Building, 2115 Second Street, Fort Myers, Florida.

 

Interested parties may appear at the meeting, in person or through a representative, and be heard with respect to the proposed ordinance.

 

Anyone wishing to appeal the decision(s) made by the Board with respect to the matters considered at the meeting will need a record of the proceedings.  Generally, a verbatim record, including all testimony and evidence upon which the appeal is to be based, will be necessary.

            PLEASE TAKE NOTICE that on Tuesday, November 4, 2014, there will be conducted a Special Election at which the voters of Lee County will be asked if they approve or disapprove of the adoption of Amendments to the Lee County Charter to become effective, if approved, on January 1, 2015. This form of the ballot will read substantially as follows:

            The election will be conducted between the hours of 7:00 a.m. and 7:00 p.m. All duly registered voters of Lee County may participate in the election. Resumen:         Enmienda del Artículo 2.2.A “Poder legislativo: La Comisión del Condado”  de la Constitución del Condado que limita el número de períodos consecutivos de la Junta de Comisionados del Condado; la enmienda limitaría a los comisionados del condado a ejercer no más de tres (3) mandatos consecutivos de cuatro años en el cargo, excluyendo los mandatos ejercidos antes del 1ro de enero de 2015.

            TENGA A BIEN SABER  que el martes 4 de noviembre de 2014 se convoca por este medio a unas elecciones por referéndum, con el objetivo de someter a los electores aptos que residen dentro de los límites corporativos propuestos de la propuesta Villa de Estero, tal como se describe en el Artículo 3 de HB 1373, la cuestión según —se expone en el artículo 12 de dicha Ley— acerca de la aprobación de dicha ley que crea la Villa de Estero y establece su Constitución.

 

            Dicho referéndum se deberá realizar según autoriza CS/CS/HB 1373, inscrito, con unas elecciones de conformidad con el Código de Elecciones de Florida tal como se reforme de tiempo en tiempo.

 

            Según se aprobó por el Artículo 12 de CS/CS/HB 1373, inscrito, la cuestión sometida en la boleta se leerá sustancialmente de la forma siguiente:
