INSTRUCTIONS TO CONSULTANTS

Pursuant to Florida Statute 287.055, Consultants' Competitive Negotiation Act, it is necessary that we receive from you a copy of your Professional/State Licenses as well as a copy of Federal GSA From 254, Architect-Engineer and Related Services Questionnaire for your company.

If you select Highway Construction, please be sure to include a copy of your Florida DOT(FDOT) certification.
 

INSTRUCTIONS TO CONTRACTORS

Contractor Licensing:  Each person or firm submitting an application must have all required license(s) at time of submittal (i.e.; General Contractor, Electrical Contractor, Specialty Trades, etc.)  MAIL A COPY OF SUCH LICENSE(S) TO THE ADDRESS ABOVE.
Insurance Requirements:  Each person or firm submitting an application must submit a certificate of insurance meeting these minimum requirements:

When your insurance coverage expires, a written renewal certificate shall be issued thirty (30) calendar days prior to said expiration date.  The policy shall provide a thirty (30) calendar day written notification clause in the event of cancellation or modification to the policy.
Workers' Compensation:  Coverage to apply for all employers for Statutory Limits in compliance with the applicable state and federal laws.  The policy must include Employers' Liability with a minimum limit of $100,000 each accident.   The certificate shall include a waiver of subrogation from the carrier.
Workers' Compensation Law:  All private employers within the construction industry having one (1) or more employees are required to have workers' compensation coverage on all of the employees.  Every employer in the construction industry is considered an employee.  However, any sole proprietor, up to three (3) partners, or up to three (3) corporate officers can elect to exempt themselves.

If you meet the above criteria a workers' compensation certificate of insurance must be provided.  If you are exempt, your exempt certificate must be provided.  If you are exempt and do not have a certificate issued by the state you must apply and provide same before being placed on the bidders list.
*Commercial General Liability:  Shall have minimum limits of $300,000 per occurrence.  Combined Single Limit for Bodily Injury Liability and Property Damage Liability.  This shall include Premises and/or Operations, Independent Contractors and Products and/or Completed Operations, Broad Form Property Damage, and a Contractual Liability Endorsement.  Said coverage must be on an occurrence basis.
Business Automobile Policy:  Shall have minimum limits of $300,000 per occurrence.  Combined Single Limit for Bodily Injury Liability and Property Damage Liability.  This shall include Owned Vehicles, Hired and Non?Owned Vehicles, and Employees Non-Ownership and be based on occurrence basis.
*Asbestos Abatement Liability:  Only required if the person or firm is submitting an application as an asbestos abatement type contractor.  Shall have minimum limits of $300,000 per occurrence.
*Prior to a Contractor receiving an award of a contract, a revised certificate of insurance for Commercial General Liability and Asbestos Abatement Liability (if required in the bidding document) shall be provided to the Department of Public Works, adding, "LEE COUNTY BOARD OF COUNTY COMMISSIONERS, ITS OFFICERS & EMPLOYEES SHALL BE INCLUDED AS AN ADDITIONAL INSURED".
If a County project is out for bid with any of the below listed insurance requirements, the Contractor will be required to provide a certificate of insurance, in the stated limits in the bidding documents, prior to receiving an award of a contract.
Worker's Compensation:  Same as stated above with the addition of employees engaged in activities in, on, or around navigable waters are to be covered under the Longshoreman and Harbor Workers Compensation Act and/or Jones Act .

Watercraft Liability in the amount indicated in the bidding document.  Lee County Board of County Commissioners, its officers & employees shall be included as an additional insured.

All Risk, Builders Risk or Installation Floater in the amount indicated in the bidding document.   Lee County Board of County Commissioners, its officers & employees shall be included as an additional insured.

The certificate holder should be listed as Lee County Board of County Commissioners, Attention: Public Works, P.O. Box 398, Fort Myers, FL 33902.

Thirty (30) days notice of cancellation is required.

NOTE:  If a County contract is out for bid with insurance limits higher than indicated above, the bidder will be required to submit an updated certificate of insurance, prior to receiving an award, showing the increased limits, unless previously submitted insurance has adequate limits.

MAIL A COPY OF SUCH INSURANCE CERTIFICATE TO THE ADDRESS ABOVE.
