PLEASE BE ADVISED that on the 11th day of September, 2012, at 9:30 A.M., or as soon thereafter as may be heard, in the County Commissioners' Chambers, Lee County Courthouse, 2120 Main Street, Fort Myers, Florida, the Board of County Commissioners of Lee County, Florida, will consider and take action on the adoption of a Resolution authorizing the exchange of public property for other real property pursuant to §125.37 of the Florida Statutes.
The real property interests to be exchanged are all located in Section 15, Township 45 South, Range 22 East, on the west side of Stringfellow Road (S.R. 767), about half way between Pine Island Center and Saint James City, as follows:
The interest in public property to be conveyed by Lee County is a 60-foot wide, non-exclusive easement for vehicular and pedestrian ingress and egress, and the placement of utility lines, in and over portions of the following County-owned properties:
1. The east 2,005.10 feet of the south 60 feet of the property described in the Warranty Deed of Pine Island Palms of SW Florida, Inc., to Lee County, dated June 12, 2008, recorded June 27, 2008, in the Public Records of Lee County, Florida, in Instrument Number 2008000174094;
2. The west 60 feet of the property described in the Warranty Deed of Robert Miller, Trustee of an unrecorded Trust dated 2-25-1992, to Lee County, dated July 19, 2002, recorded July 22, 2002, in Official Records (O.R.) Book 3689, Page 4657;
3. The north 500 feet of the west 60 feet of the property described in the Warranty Deed of Richard L. Tompkins, Trustee, to Lee County, dated March 16, 2001, recorded March 22, 2001, in O.R. Book 3380, Page 1516; and
4. The north 60 feet of the property described in the Warranty Deed of Rachelle Farrow to Lee County, dated December 10, 2008, recorded December 18, 2008, in Instrument Number 2008000329102.
The property interest to be received by Lee County is all right, title and interest in a 60-foot wide easement of the named property owners, as first created in a Grant of Easement of Richard L. Tompkins, Trustee, to the Corner Company of Fort Myers, Inc., dated January 15, 1991, and recorded in the Public Records of Lee County, Florida, in O.R. Book 2197, Page 3680; subsequently assigned to other property owners in the Southwest quarter of Section 15 and the Southeast quarter of Section 16, in Township 45 South, Range 22 East, Lee County, Florida, in the Assignment of Easement of the Corner Company of Fort Myers, dated December 7, 1992, and recorded in O.R. Book 2346, Page 71; and taken subject to by Lee County in the Warranty Deed of Richard L. Tompkins, Trustee, dated March 16, 2001, and recorded in O.R. Book 3380, Page 1516.
The terms of the exchange will be the County's conveyance of the first above-described easement in return for the receipt of all right, title and interest of the named property owners in the last above-described easement. The participating property owner(s) to the exchange will be responsible for all subsequent costs of permitting, construction and resulting maintenance of the replacement access easement.
Parties to the exchange will be Lee County, Paul Dinger and Susan Monaco. If the Resolution of Exchange is adopted, the closing of said exchange will follow thereafter in accordance with the terms of the Board's Resolution.
